A resident of San Francisco has filed a class action lawsuit against Tesla due to the phantom braking issue that was reported last fall. The problem forced Tesla to roll back the beta version of the FSD software and a federal investigation is in place.
The proposal for the lawsuit says that there are hundreds of thousands of other Tesla owners that could join the suit and seek damages. The lawsuit itself accuses Tesla that it didn't convey the risks of using Autopilot, breaching its warranties as well as violating California's fair competition law.
There are several reports of Teslas slowing down or braking suddenly due to a front collision danger when there's no object in sight or even close enough to the car.
Interestingly enough, after Tesla rolled back its software, the number of complaints about phantom braking spiked in the NHTSA (National Highway Traffic Safety Administration). That's why the office began the investigation in the first place.
Some believe that the issue began after Tesla decided to remove the radar sensors from the new Model 3 and Model Y units and rely on cameras only. Coincidentally, all the reports are tied to those two specific models.
